Submitting a Notice of Alleged Infringement

  4. The following statement, verbatim: "I have a good faith belief that the use of the copyrighted materials described in this notification is not authorized by the copyright owner, its agent, or by protection of the law."
  5. The following statement, verbatim: "I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner or am authorized to act on behalf of the copyright owner."
  6. Your signature.

At the discretion of Einstein Medical, the allegedly infringing material may be removed from the website in question, or access to the material may be restricted. Einstein Medical will also document your written notification and send it to one or more third parties that will make it part of the public record.

Submitting a Counter-Notification

Upon receipt of a copyright infringement complaint, Einstein Medical will make a good-faith attempt to inform the provider of the affected content so that he or she can file a DMCA counter-notification. Counter-notifications must be submitted by written letter. They may not be submitted by email without:

  • Prior consent of an authorized representative of Einstein Medical.
  • The digital signature of a verified, trusted third party.

To ensure that Einstein Medical is able to process your counter-notification in a timely fashion, please make sure that your written letter includes:

  1. A detailed description of the material that Einstein Medical has removed or to which Einstein Medical has disabled access, including a web page URL.
  2. Your mailing address, telephone number, and email address.
  3. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which you reside (or San Diego, California if you reside outside of the United States).
  4. The following statement, verbatim: "I swear, under penalty of perjury, that I have a good faith belief that the material described in this notification was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.
  5. Your signature.

If Einstein Medical receives a properly submitted counter-notice, the company will inform the party that submitted the original infringement complaint. That party will then have fourteen days to file a lawsuit against the party that filed the counter-notice. If no lawsuit is filed, Einstein Medical may, at its discretion, restore the material.

Account Termination

Einstein Medical will, in appropriate circumstances, terminate the account of any account holder who repeatedly infringes the copyrights of others. If you believe that such an account holder has repeatedly infringed your copyright, please follow the instructions provided above to inform Einstein Medical's DMCA agent, along with examples of multiple violations to demonstrate that the account holder is a repeat infringer.
